If someone is swearing or offending you, but they have you muted, do you have the right to warn them, then suspend them etc. I want to know because it doesn't say anything about being able to do it to muted players.

You cannot do anything if people mute you. If you want to be safe though, mute the other person until someone tells you otherwise. That would be my suggestion.

(They can still kick you from the party for muting you though according to section 3 of the CoC)

if someone has you muted, you don't know if there offending you since you cant hear them yourself its Heresay, however if the person is talking to more then one council member and they hear this person, continuing on after a mute is in place then its there duty as a UXAC to issue the warning to said offender,

and shod the right to kick from your own party would only help if your the party leader as you cant ask the leader to kick people from other party's
